Sydney Sheds and Garages Terms and Conditions
1. Upon signing of contract, purchaser will pay 10% deposit. If council permission is unobtainable deposit is refundable less minimal fee for work done on application. After this point the deposit is non-refundable.
2. The purchaser warrants that he/she/they are entitled to erect the kit on the site specified overleaf. The purchaser will clearly identify the area on which the kit is to be erected prior to commencement of any work. The purchaser will indemnify Sydney Sheds and Garages against any claims, losses or demands that may be brought by any pawn claiming to be the rightful owner of the site.
3. If a customer decides to erect the kit themselves or with unknown persons, all materials need to be checked on delivery of kits as no requests for shortages will be accepted after delivery.
4. The balance of the said kit is to be paid by cash or bank cheque prior to the delivery of the said kit. If client is unable to take delivery of said shed within seven (7) days of being contacted the balance of the shed is to be paid for in full.
5. We will supply phone numbers for builders and concreter if you require one. The builder or concreter is not an employee of Sydney Sheds and Garages. The builder or concreter will be a contractor to the purchaser. Payment is payable to the contractor on completion of job if the contractor is not paid on completion he will lock the shed and give the keys to Sydney Sheds which you will be able to redeem on receipt of payment.
6. Demolition, cartage, electrical and plumbing work are not included in this quotation unless otherwise stated.
7. Once site access is granted for concrete trucks the purchaser bears all the responsibility for any damage caused by vehicles or excavation equipment. If access is not granted the purchaser agrees to pay for a concrete pump.
8. In the event of inclement weather or other such delays, the purchaser is still bound to accept delivery or at least pay for kits within seven (7) days of their arrival in Sydney Sheds warehouse.
9. The purchaser agrees to accept the said kit within seven (7) days of notification from supplier. If delivery is not accepted by this time a $50 storage charge per week will apply. Full payment of kit will be required.
10. The purchaser agrees to obtain and pay for all building permits, insurances and fees a may be required by any public authority and that the supplier has no responsibility to do so.
11. The purchaser acknowledges that it will be his/her/their responsibility to obtain all development consents and that if Sydney Sheds and Garages are to submit applications to any public authority it is on the clients behalf only. Once council approval is obtained Sydney Sheds and Garages will supply a copy of approval plans and the client is then responsible to obtain water board approval.
12. The supplier undertakes to provides plans and specifications for the said kit but the plans may need to be modified by the purchaser to take account of the proposed site or any special requirements of either the purchaser or any public authority for the erection of the said kit.
13. Any modification request to the builder or concreter needs to be in writing from purchaser and submitted to Sydney Sheds office.
14. The purchaser acknowledges that it will be his/her/their responsibility to connect the said kit to the storm water system and or provide such work at his/her/their own expense to satisfy any public authority and that the supplier has no responsibility to do so.
15. Sydney Sheds and Garages will do its best to supply kits on time but will not be held responsible for delays caused by industrial action, lack of supply, strike or any other circumstance beyond its control.
16. In the event of material cost increases, Sydney Sheds and Garages will endeavor to absorb as much as possible but cannot guarantee that some extra increases will not be passed onto the customer.
17. The quotation is an offer by Sydney Sheds and Garages to sell the “kit” specified overleaf and is conditional on the approval by the director/partners of Sydney Sheds and Garages.
18. The purchaser acknowledges that any excavation work, and unforeseen obstacles, rock pipes etc. are not included in this agreement and the purchaser will have to pay for any additional work at his/her/their own expense.
19. The builder is not responsible for removal of left overs after erection.
20. Please note if electricity is not available on site there will be a hire fee for generator usage.
21. The purchaser acknowledges that once the shed components are delivered to their designated site, all responsibility for theft and damage to such items transfers to the purchaser.
22. Any over supply of building materials delivered to site, remains the property of Sydney Sheds and Garages once erection of shed is complete.
Sydney Sheds and Garages Payment System
1. Pay 10% on acceptance of work
2. Payment for plans and council fee if applicable
3. Pay concreter on completion of concrete work if applicable
4. Pay balance of garage and delivery prior to shed being delivered
5. Pay builder for garage erection on completion of garage
